ELEVAI TERMS OF SERVICE (effective 10/16/2026)
1. Agreement
These Terms of Service ("Terms") govern your use of elevaiskincare.com (the "Site") and your purchases from Elevai Skincare, Inc. ("ELEVAI," "we," "us"). By using the Site or placing an order, you agree to these Terms and to the policies referenced in them: our Privacy Policy, Shipping Policy, Return and Refund Policy, and Subscription and Cancellation Policy. If you do not agree, do not use the Site.
2. Eligibility
You must be at least 18 years old and a resident of the United States to create an account or place an order.
3. Cosmetic Products; Not Medical Advice
ELEVAI products are cosmetics. They are not drugs and are not intended to diagnose, treat, cure or prevent any disease or medical condition. They are for topical use only and must not be injected or delivered intravenously. Content on the Site is for general information and is not medical advice. Consult a licensed healthcare professional with questions about your skin or medical condition. Stop using and consult a professional if irritation occurs. 4. Accounts
You are responsible for keeping your account credentials confidential and for all activity under your account. Notify us promptly of any unauthorized use. We may suspend or close accounts that violate these Terms.
5. Products, Pricing and Availability
Prices are in U.S. dollars and may change without notice. Product availability is not guaranteed. We try to describe products and prices accurately; if a product is listed at an incorrect price or with incorrect information, we may cancel the order and refund any amount charged.
6. Orders and Payment
Your order is an offer to buy. We accept it when we ship the products. We may limit quantities or refuse or cancel any order, including orders that appear to be placed by resellers or that we suspect are fraudulent. If we cancel after charging you, we will refund the charge. You authorize us to charge your payment method for the order total, including shipping and applicable sales tax.
7. Personal Use; No Resale
Products sold on the Site are for personal use. You may not resell them, including on third-party marketplaces, without our written consent. Professional purchases are governed by the ELEVAI Professional Terms of Sale.
8. Shipping, Returns and Subscriptions
Shipping, returns, refunds and subscriptions are governed by our Shipping Policy, Return and Refund Policy, and Subscription and Cancellation Policy, which form part of these Terms.
9. Intellectual Property
The Site and its content, including text, images, logos and the ELEVAI name and trademarks, are owned by or licensed to ELEVAI and protected by law. You may view and print content for personal, non-commercial use only. You may not copy, modify, distribute or use our content or trademarks without our written permission.
10. Reviews and Submissions
If you post a review or send us feedback, it must be truthful, reflect your own experience, and not be unlawful, misleading or infringing. You grant ELEVAI a non-exclusive, royalty-free, perpetual license to use, reproduce and display your submission in connection with our business. We do not pay for or edit reviews to change their meaning, and we may remove submissions that violate these Terms.
11. Prohibited Uses
You may not use the Site to break the law; interfere with its operation or security; scrape or collect data by automated means; impersonate anyone; or post harmful, false or infringing content.
12. Third-Party Links
The Site may link to third-party websites, including social media and provider directories. We do not control or endorse them and are not responsible for their content or practices.
13. Disclaimer of Warranties
THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." EXCEPT AS STATED IN OUR RETURN AND REFUND POLICY, AND TO THE EXTENT PERMITTED BY LAW, ELEVAI DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. RESULTS FROM SKINCARE PRODUCTS VARY BY INDIVIDUAL. SOME STATES DO NOT ALLOW THESE EXCLUSIONS, SO THEY MAY NOT APPLY TO YOU.
14. Limitation of Liability
TO THE EXTENT PERMITTED BY LAW, ELEVAI WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, AND OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE OR A PRODUCT WILL NOT EXCEED THE AMOUNT YOU PAID FOR THAT PRODUCT. SOME STATES DO NOT ALLOW THESE LIMITATIONS, SO THEY MAY NOT APPLY TO YOU.
15. Indemnification
You agree to indemnify ELEVAI against claims arising from your violation of these Terms or misuse of the Site.
16. Governing Law and Venue
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law rules. Any dispute will be brought exclusively in the state or federal courts located in Allegheny County, Pennsylvania, and you consent to their jurisdiction. Nothing in this section limits rights you have under the consumer protection laws of your state of residence.
17. Copyright Complaints (DMCA)
If you believe content on the Site infringes your copyright, send a notice meeting the requirements of 17 U.S.C. § 512(c)(3) to: Customer Service, Elevai Skincare, Inc., 2403 Sidney Street, Pittsburgh, PA 15203, info@elevaiskincare.com.
18. Changes to These Terms
We may update these Terms by posting a revised version with a new effective date. Changes apply to orders placed after the update. Continued use of the Site means you accept the revised Terms.
19. General
If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms and the referenced policies are the entire agreement between you and ELEVAI about the Site and your purchases.
